Terms and Conditions
These Terms and Conditions apply in relation to Your attendance and participation at the IBD Ecolab Trade night to be held from 22 – 23 February 2021.
1. Definitions
The meanings of the defined terms used in these Terms and Conditions are set out below.
• IBD means Institute of Brewing & Distilling (IBD) – Asia Pacific Company Ltd, PO Box 3425, Russell Lea, NSW 2046, Australia, ABN 46 095 858 272.
• Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 and the corresponding provisions of any applicable state or territory laws.
• Claim means any action, suit, claim, proceeding, demand, Loss, damages, cost and expense of any nature whatsoever.
• Event Organisers means IBD and TRIBE collectively and individually.
• Event means the IBD Ecolab Trade night to be held virtually from 22 – 23 February 2021.
• Loss means any claim, action, damage, loss, liability, cost, charge, expense suffered or incurred, whether direct, indirect or consequential and whether arising in contract, tort (including negligence), statute or otherwise.
• Registration Fees means the fees payable with respect to the Event (if any).
• Terms and Conditions means these terms and conditions.
• TRIBE means Tribe Travel & Events Pty Ltd ABN 52 620 641 812 (trading as TRIBE Management).
• You/Your means the person who agrees to these Terms and Conditions.
2. Limitation of liability and release
2.1 You may have certain rights under the Australian Consumer Law or other applicable law that cannot be lawfully excluded or limited (Consumer Rights). Nothing in these Terms and Conditions applies to the extent that it is inconsistent with Your Consumer Rights.
2.2 To the extent lawfully permitted, the Event Organisers and their directors, officers, employees, agents and contractors, are not liable to You for any Loss arising from or in any way connected with, the Event.
2.3 To the extent lawfully permitted, You release and forever discharge the Event Organisers and their directors, officers, employees, agents and contractors from all Claims which You may otherwise have for Loss to property (including but not limited to personal property or belongings) and bodily injury or death however caused, including (without limitation) if caused by negligence or otherwise, arising from or in any way connected with, the Event.
3. Indemnity
To the extent lawfully permitted, You indemnify and agree to hold harmless the Event Organisers and their directors, officers, employees, agents and contractors, in respect of any Claim by any person including, without limitation, You, an Accompanying Person or another Event attendee, arising as a result of or in any way connected with Your and/or any Accompanying Person's attendance or actions at the Event.
4. Force majeure
If the Event is cancelled in its entirety by the Event Organisers for any reason beyond their control, including but not limited to fire, flood, strikes, riots, civil disturbance, government regulations, natural disaster, severe weather conditions, mechanical malfunction or other conditions which make it impossible, illegal or inadvisable to hold the Event, the Event Organisers will, in the exercise of their absolute discretion: (a) reschedule the Event for another date; or (b) refund monies paid to the Event Organisers by You for the Event less expenses incurred by the Event Organisers in connection with the Event and any amount usually recoverable under a comprehensive travel insurance policy. To the extent permitted by law, the provision of either (a) or (b) will fully discharge all obligations of the Event Organisers to you and be in full and final settlement of any Loss to you.
5. Privacy
The Event Organisers will use your personal information to make arrangements in connection with the Event and may disclose your personal information to third parties who assist in providing services in connection with the Event and any sponsors of the Event. These third parties may include (but are not limited to) hotels, airlines, tour operators and venues. If you do not provide your personal information you will not be able to register for the Event. The Privacy Policy of each Event Organiser contains information about how You can access Your personal information and request correction or complain.
6. Cancellation fees
By submitting your registration, you agree to adhere to the IBD 2021 Virtual Convention Cancellation and Payment Terms as follows:
- Cancellations up to 30 January 2021 - full refund of registration fee excl. credit card surcharges and bank fees paid at the time of registration (if applicable), less $ 15 Administration fee
- Cancellations after 30 January 2021 are non-refundable and full payment will be retained
- All cancellations must be made in writing to the TRIBE - Travel & Events team by emailing ibd2021@tribemanagement.com.au
7. Governing Law
This agreement is governed by the laws in force in the State of Victoria and each party irrevocably and unconditionally submits to the exclusive jurisdiction of the Victorian courts.

This agreement is entered into between You and the Event Organisers.

• I will comply with and be bound by the Terms and Conditions.
